High Court of Australia clarifies who is a Company “Officer” andASIC dance in the storm over Federal Court appeal
2020 has been a big year for the Australian Securities and Investments Commission (ASIC) with two significant decisions handed down by the Courts. After lengthy litigation, ASIC has successfully litigated against directors and officers of two large failed financial services entities, namely Storm Financial and MFS (Octaviar) Group, with the decisions delivered in March this year.
Both cases have salient messages for company directors and officers and any person who may have an impact on the financial standing of a company that the courts will adopt broad interpretations to the Act where it is available to them.
